Tyson Foods, Coronavirus, Waterloo ACTIVIST ESSIE BERRY, EXPOSED TYSON MANAGERS, CORONVIRUS..OHSA INVESTIGATION.

I thank you for coming i’m going to put something out here. Right, quick – and i just want you guys to listen back in august of this year. I took on a case at tyson in waterloo iowa, a friend of mine, got hurt in the tyson port plant in waterloo, iowa, where they were up on a platform and they fell off the platform when they fell off the platform, they hurt their hip, their shoulder And their hand um and right now the person needs hip surgery um. They say he could possibly have to have shoulder surgery, but he’s gon na wait on it and he’s real scared. They have hip surgery the platform that he fell off of back in october 2019. It should have had a toe board, a rail guard or some type of way to tie this person off so if they should slip and fall that they wouldn’t go off and fall down on the floor. That’S. The sixth time that that incident has happened. So that tells me clearly that they didn’t take enough time to do what they were supposed to do to protect the employees or my friend at this time, my brother. So then, after all that happened, um whining for it um, they put him off work in a light of duty for a moment, but they were still like working him. They had to change around several times. I came on the case in the end of july because when he came back to work, something had transpired and happened where this young lady was working a machine right next to him and she got burnt with second and third degree burns.

The safeguard was not on the machine correctly and when the blade spent there was no safeguard and when the blade spent it splashed and it broke this girl flesh off her back my my person. My client was traumatized by this. No one enticed a record recognized mental trauma. That was the first thing. The second thing was when i went back over some of his reports, the doctor clearly said: do not lift over 20 pounds. They had him lifting 500 pounds and i just told you his hip is messed up for the rest of his life, so he has to have surgery, so he should not have been lifting anything. Then adding insults to injuries iowa is a at will state. So that means that you can fire in someone at the drop of a dime. This man had been with this company over 13 years when they tried to bring him back. He was not able to do what he was supposed to do, because he was still pretty much on light duty, but they didn’t care. They brought him back at mmi, maximum medical improvement and because of that, they started working at back, but the doctor still had not took him off his restrictions, which was a violation to tyson another violation to me, and it should be to any company if a doctor Prescribes someone some type of medication and they are injured if it alters their mind their capacity, their thinking their drowsiness, the way they operate, then you should not be operating any machinery.

I really looked at all this man’s um medication that he was taking. It clearly said, do not operate with machinery, and indeed they did that. I can also say to and tyson it has been retaliation discrimination, places, man and fear, reprisal, emotional, mental duress and i’mma be honest with you, like, with all the ocean violations. The investigation started back in august and tyson covered up a lot of things. I also put in the complaint that i said that tyson was covering up um injuries that go on in there. So for say, there was a guy who fell through the roof. You know who you are tyson covered, that up and then didn’t. Let him go to the hospital when that young lady got burnt with those second degree burns. They patched that girl up in that pig farm and told her not to go to the doctor. She said the pain was so extensive. She had to go get something because they didn’t even give her any cream for her back less than three days later out of getting a second and third degree burn. They brought her back and continued to work her. After all, that transpired, when my client came back to work and when that transpired the first day it happened, they sent them home the next day he was still traumatized. He said he could still smell the flesh in her clothes and they didn’t think about none of that. He was still limping on his left hip and he told his supervisor, which is a caucasian lady he’s, a black man she’s, he said, look i’m hurting.

I don’t feel well. She said i don’t care. Take your ass back to work shut up. Nobody wants to hear your damn complaining that just created a hostile work environment and who was her or who did she think she was that she could talk to any employee. Like that, because you’re a supervisor, how dare you they also had what you call nepotism when you have a family member working with you, but because you got a family member working with you, don’t mean that you can talk to someone crazy. That was a problem to me as well, that created more hostile work environment which caused more um hostility with this man, because he was still saying: yo, i’m hurting i’m in pain and y’all, not doing anything. So then, after all that transpired and they brought him back, they continue to try to work, write him up for issues that were not relevant, trying to fire him. Knowing he had hurt his hip, knowing he needed surgery on his shoulder and his thumb anonymous thumb, but on his shoulder and his hip, what i couldn’t understand also, i found a complaint allowing ocean to know that i felt that tyson was taking kickbacks. They were kicking back to the point that they were paying osha to come in and say: oh there’s, nothing wrong! Oh it’s clean in here. Oh there are no safety violations. I believe tyson was paying somebody in ocean to take kickbacks to say that the plant was up to park and it was not up to par, because if that was the case, six people would not have failed from that platform.

That woman would not have been burnt with second or third degree burns. The person who fell through the roof would not have fell through the roof and there’s other issues as well that, if somebody wanted to, they could start a class action lawsuit against tyson. I can clearly tell you, too, that the upper management um and the human resources they all suck they’re disrespectful, they’re racist. They don’t, listen, they don’t care they’re, just up there to do a paycheck. They don’t care about any of tyson. Employees, no concerns no nothing. Several times they tried to disrespect me as a black woman, because i was standing for what i believe in and what i was trying to do is show them that you cannot violate any employees. It doesn’t matter what color your skin is, but because i came so raw and so direct tyson clearly could not handle it. No one in hr could handle it. Nowhere in the tyson building could have it, so they passed me over to attorney and he doesn’t know anything about discrimination. Racism, retaliation, fear, reprisal, emotion, mental duress, hostile work environment, he’s a workman’s comp attorney, but i can still tell you he’s trying the best that he can. We had a few discrepancies but he’s still a good guy, pretty decent um everybody who was in the human resources who could have made a difference, the head supervisor and the assistant supervisor, which is a female. They both need to be replaced, they don’t have they.

Don’T have compassion for human life. They don’t respond to any emails. It took them almost three months to give me paperwork that i asked for, and then they continued not to give me paperwork that i asked for which i thought was very insulting. They have a case manager, there i’m, not even sure, if he’s licensed he does not do his job at all. They have tried to fire this man since i’ve been on this case, which i’ve stopped. They also stopped his insurance. They stopped his medical insurance, knowing that they were the full cause of all this that had transpired and went on, knowing that he had to have hip surgery. I also believe that tyson has been paying work, doctors to give low impairment ratings on black employees or any employees, so they don’t have to pay them anything for the uh injuries that they have occurred and why i say that there was a doctor, this man, my Client had supposed to have um, hip surgery or his hip should be replaced, but he’s scared at this time. So i contacted three doctors at three different states hip specialist. Just to see they said, there’s no way that you can have a zero impairment rating and you have to have surgery, so that meant either. This doctor is a liar or tyson paid this doctor to give this man a zero impairment rating, so they could come back to work and when he came back to work he got re injured at work and right now, i’ve turned two doctors over to the medical Board in iowa because i’m, stating that they’re getting low impairment ratings, they’re not diagnosing the clients what they should, and i believe that tyson is paying these doctors.

These cop workmen comp doctors for low impairment ratings, so they won’t have to pay out the pocket when you’re. In a company and it’s called workman’s comp, when every time a person gets injured, that’s a red flag, you can’t have a certain amount a year. Somebody in there, which i won’t call them names. They know who said it they said we don’t want to have all those injuries, because they’ll come back and bite us, because you’re not supposed to have that many adding insults to injuries. There has been about seven um managers who got fired up in there, y’all see where it says that tyson completes investigation of the wage allegation at waterloo plant fire, seven managers: these managers were betting on employees to see who would die from the corona virus. First, how disrespectful is that? How sick mean is that? How disgusting is that that you got a bunch of big time supervisors sitting in the office bending on people like they just mere cattles and me or whatever, and that they’re gon na bet them to die while they’re warm, while the other employees sit up there working In the pig farm stop it now tyson president ceo dean banks, he said the behavior exhibit by these individuals do not represent the tyson core values. It may not represent the tyson core values, but they have been in there a long time and it’s been a long. A lot of employees that have been complaining a lot of employees been hurt when they got all this transpired in april.

Why didn’t y’all come in then mr dean? There was a man who died from corona virus. Why didn’t you come in there, mr dean i’m, just asking there should have been a whole new uh protocol up in that place. When you took somebody else’s life, and now they know that you had supervisors betting on people to see when they would die. How do we not know they didn’t do that in april, when that man died i’m, just saying, which is why we took immediate and appropriate actions to get the truth. Now that the investigation has concluded, we are taking actions based on the findings. Now i told you we did the we started this investigation in august. I wrote every board member at tyson because i got tired of playing with the high profile supervisor in hr. That was not doing their job. They sent up their like doing, saying things, but they weren’t answering any emails. They won’t respond to anything. They was not corresponding anything. I asked for the ocean 300 reports. They would never give them just now. The other day i just received the osha 300 logs that’s, for when someone gets hurt in a facility, everything should be recorded when it happened how it happened, which way happened like that they would never get those reports up. You could tell too that you just recently just typed them in you, could tell somebody just recently did something a lot of those reports.

Weren’T even done right, a lot of the information that we asked for they didn’t give a lot of thing and being real. It was very easy, very, very easy to prove racism. It was very easy to prove discrimination, retaliation. Every allegation that they have said i’ve been able to prove beyond the shadow of doubt 100, and it just gets worse to know that this man got hurt and they want to stop his insurance. They did to know that he got hurt and they tried to determine him. He did tyson when they’re talking about this doesn’t represent the core. What does it represent when people are getting broke down, beat up hurt up in your place, falling through rules falling off platforms? No safety issues and then all this continue to happen and someone died in your plant from coronavirus. It represents something, and it doesn’t represent good faith and i’m, not trying to come down on mr dean banks. But since you’re up in there we’re going to cover everything, then we need to make sure that we cover everything, because i told tyson that i would not walk away until i make sure that every employee in tyson is saved one thing they did. They chose the wrong brother to come at and disrespect like they did. That was their first mistake. That was their choice. To do that, when i came nicely to them as a civil rights activist they wanted to come to me like i was some kind of flunky off the street, but they didn’t like my demeanor, nor that they liked that i was so straightforward until the point i Don’T have time to lollygag.

When you got people dying from the coronavirus, you have people falling off platforms, you got people getting burnt with second and third degree burns and you try to patch them up in a pig farm, not cause considering anything about human life. How disgusting the safety man that was up in there he know who he is. He told me it’s not his concern if an employee coming there on any type of medication. If you are under any type of drugs prescriptions, anything that can disorientate you uh make you dizzy, drowsy unaware of any situation at all, guess what then you should not be on the floor, because if you clearly go back and look at the direction it say do Not operate machinery that day will miss my client. I don’t want to call his name well. My client was going through what he was going through and he was telling that he was hurting. He was tired and he couldn’t do this because he was at pain. They didn’t care. When that girl got hurt, they didn’t even recognize trauma. She was traumatized, and so was he because he just saw somebody get their flesh burnt off of their back and they cared nothing about it. To know that these people were up here, betting on other employees, i found that just very disgusting by itself. I’Ll, let you guys read this while i’m going to further. Yes, they have um fire several supervisors, but they need to fire everybody in there.

No one who was suspended with pay should come back whether mr dean says this do not reflect tyson. It reflects tyson as a whole, because you’ve had these people up in there for quite some time. It wasn’t up until now that we started making noise and going to ocean calling phones and i’ve got the eeoc involved. The civil rights commission born involved that i were born, involved it wasn’t to then that we started making noise that somebody heard something. I have to say too that i am very appreciative because the vice president of tyson did reach out on some of the concerns, but there still is an investigation but i’m putting on out the investigation of not because i don’t like the way they handle certain things That went on with this investigation. They gave what they wanted to give. They chose to do what they want to do. That’S, why the whole waterloo iowa plant is up for an investigation now and they’re taking appropriate actions. You should have took appropriations when that man died with the coronavirus this part in april. You guys, i put this letter up there, so you can see what’s going on for yourself there’s still some more things going on there’s still a pending investigation. I went to tyson several times and saying hey how we gon na come to a peaceful resolution, it’s, not right that you sit up there. Let supervisors cuss people out it’s, not right that you have to work and do things and you can’t um it’s, not right! That you have to work and do things and you can’t do right by your employees.

If you can’t do right behind your employees, then you’re not going to do right by anybody else. So at this time i just want to put that out there. You guys so y’all can see what was going on. The initial i feel investigation is going to be positive. I do understand that a lot of people have been removed from there, but i want everybody who removed remove from there who didn’t make this right in the first place. Tyson need to stand accountable and be held accountable for all the actions. Any employees who died up in there any employees who have been injured, hurt mentally physically emotion is on tyson, and one thing that everybody needs to have from here on out is human compassion, which nobody in the human resources not even a case manager to be had Human compassion take care of you guys.
